Nebraska Prostitution Laws: Charges, Penalties & Defenses

What Constitutes Prostitution Under Nebraska Law

Nebraska Revised Statute 28-801 defines prostitution as performing, offering, or agreeing to perform any act of sexual contact or sexual penetration with a person other than a spouse in exchange for money or another thing of value. Nebraska law doesn’t limit charges to one party in a transaction. Both the person offering and the person receiving sexual services can be charged under the statute.

How a charge is classified depends on the defendant’s conviction history. A first offense or a charge with one prior conviction is a Class II misdemeanor. Two or more prior convictions elevate the offense to a Class I misdemeanor. For purposes of calculating prior convictions, Nebraska counts any conviction on or after July 14, 2006, for a violation of NRS 28-801 or a city or village ordinance relating to prostitution. Probation for any conviction under NRS 28-801 includes a mandatory mental health and substance abuse assessment conducted by a licensed professional.

Solicitation of Prostitution Under NRS 28-801.01
